What personal data we collect and why we collect it

When you access the website , information of a general nature is automatically collected. This information is recorded in the server log file and includes the type of web browser, the operating system used, the domain name of your Internet service provider, your IP address and the like.

Comments

When visitors leave comments on the site, we collect the information displayed in the comments form, as well as the visitor's IP address and user agent string (which identifies the browser) to help spam detection.

An anonymized string of characters (also called a hash) can be created from your email address and  given to the Gravatar service to check if it is using it. After your comment is approved, your profile picture will be publicly visible in the context of your comment.

Media

If you are a registered user and upload photos to this website, you should avoid uploading photos with an EXIF GPS location. Visitors to this website may download photos stored on this website and extract their location information.

Appointment and contact forms

The data you enter will be stored for the purpose of individual communication with you. For this purpose, you must provide a valid e-mail address and your name. This is used to assign the request and then answer it. The provision of further data is optional.

Contact

The information provided by users may be stored in our customer relationship management system and marketing automation platform ("CRM & Marketing System") or comparable request organization.

We use the CRM, registration and marketing automation system "HubSpot", from the provider HubSpot Inc. (25 First Street, 2nd Floor, Cambridge, MA 02141, USA) with branches in Ireland (One Dockland Central, Dublin 1, Ireland) and Germany (Am Postbahnhof 17, 10243 Berlin) on the basis of our legitimate interests (efficient and fast processing of user enquiries, applications and optimisation of our online offer). To this end, we have concluded a contract with HubSpot with so-called standard contractual clauses, in which HubSpot undertakes to process user data only in accordance with our instructions and to comply with the EU data protection level. Our sign-up service allows visitors to our website to learn more about our company, download content, and provide their contact information and other demographic information. This information is processed and stored on servers of our software partner HubSpot. They may be used by us to contact visitors to our website and to determine which services of our company are of interest to them. All information we collect is subject to this Privacy Policy. We use all the information collected to optimize our marketing, to match inquiries and then to respond to them and, if desired, to contact you.

We delete the requests if they are no longer necessary. We review the necessity every two years; We store inquiries from customers who have a customer account permanently and refer to the customer account details for deletion. In the case of the statutory archiving obligations, the deletion takes place after their expiry (end of the retention obligation under commercial law (6 years) and tax law (10 years)).

Transfer to third countries

Social Plugins

Social media plugins are used on our websites  . These plugins may be used to send information, which may include personal data, to the service provider and, if necessary, used by it. We do not collect any personal data ourselves by means of the social plugins or through their use.

We have no influence on what data an activated plugin collects and how it is used by the provider. Google AdWords

Our website uses Google conversion tracking. The operating company of the services of Google AdWords is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. If you have reached our website via an advertisement placed by Google, Google Adwords will  place a cookie on your computer. The conversion tracking cookie is set when a user clicks on an ad served by Google.

Data collected:

General information collected automatically when you access the Contract Products online. This information is recorded in the server log file and includes the type of device and/or web browser, the operating system used, the domain name of the Internet service provider, the IP address and the like. 

Access data to the User's account, namely the User's e-mail address or mobile phone number and the password chosen by the User. 

General identification information provided by the user or the employer, in particular first and last name, date of birth, AHV number, VAT number, etc.

All User Content such as certificates of completed training, diplomas, job references, reference letters, profile pictures, photos, etc. 

Data on the assignments of the users such as location and address, responsible persons, telephone numbers of those responsible for the assignment, duration of the assignment, etc., as well as any assignment or rental contracts released or uploaded by the personnel service provider in the system.

By showing the personal Equasio user QR code, the user authorizes a third party (e.g. the supervisor of the data controller during the performance of his or her work, etc.) to view his or her personal data.

 

How long we store your data

For users registered on our platform (by the user himself or on behalf of the hiring company or the company with whom Equasio has entered into a contractual relationship), we also store the personal information provided in the respective user profiles. This data is stored for as long as the associated user account is active.

The data will be deleted as soon as they are no longer required for the purpose of collection. 

Equasio assumes that a user account is active if an action (login, scan, change of user data, etc.) has been carried out or there is  an assignment at a company.

What rights you have over your data

All users can view, change or delete their personal information at any time (the username cannot be changed). Administrators of the website and platform can also view and modify this information.

If you have uploaded your own IDs and documents to your profile,  which you do not want to make accessible to third parties by scanning yourpersonal QR codes, you canmark them as private. No one but you will have access to it.

If you have an account on our platform or have left comments, you can request to receive an exported file of your personal data from us, including any data you have provided to us.

In addition, you can request the deletion of any personal data we hold about you. This does not include the data we are required to keep for administrative, legal or security reasons.

If an assignment at a company is terminated and you have no further ongoing assignments,  we wouldreserve your user account for deletion and inform you by push message, SMS, etc. inform you of this. If you do not respond to this message,  your user account will be deactivated after 30 days and permanently deleted on the next January 1 of the year (but after  90 days at the earliest).

Installing the app

The app is available through third-party distribution platforms called app stores (Google Play and Apple iTunes). Your download may require prior registration with the respective app store and the installation of the app store software. Equasio has no influence on the collection, processing and use of personal data in connection with your registration and the provision of downloads in the respective app store and app store software. The responsible body in this respect is solely the operator of the respective app store. If necessary, please contact the respective app store provider directly for more information.

Use of location data and Google Maps

In the Equasio platform, we use the offer of Google Maps. This allows us to show you interactive maps directly in the app and allows you to conveniently use the map function and display your current location on the map. We also use the location to  pre-fill the next company location (e.g. construction site) during training and instruction processes and when recording a safety audit.

Users usually have the option of preventing the use of location data. This can be achieved by adjusting the appropriate settings of the device, such as location services on mobile phones. These settings can be set specifically for this application, or for all applications on the device.

Disabling location data may have a negative impact on the use of this application.

Push notifications

The Platform has the ability to send push notifications to Users in order to fulfill the purposes stated in our Privacy Policy. In order to register for the push messages, you must confirm the request of your device to receive the push messages. This process is documented and stored by the operating system manufacturer. For this purpose , the login time and a device token (iOS) or device ID (Android) are stored. This data is used on the one hand to be able to send you the push messages and on the other hand as proof of your registration. These are only encrypted, anonymized device IDs. Users usually have the option to stop receiving such notifications. This can be achieved by adjusting the appropriate settings of the device, such as the notification notices on mobile phones. These settings can be set specifically for this application, or for all applications on the device.

Disabling push notifications may have a negative impact on the use of this application.

 

In order to be able to offer you this function, we use the Google Firebase service of the provider Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (hereinafter referred to as "Google"). Your data will be processed on servers in Switzerland and the EU.

 

Uploading photos 

To document security incidents and chat messages, you can add photos to the gallery in the app. For this purpose, it is necessary that you give the app access to your camera or camera. grant your gallery on your device. Access to your photos on your device to enable uploading and subsequent processing will only take place if you have given your express consent (Art. 6 para. 1 a) GDPR or the corresponding legal basis of Swiss law).

The submission of the declaration of consent is voluntary. You can revoke your consent by changing your setting in the device settings under Equasio  Camera  and EquasioPhotos.

Sending 1-Time Codes and Login Link in the App

To confirm your mobile phone number and for automatic login, we use the Twilio service tool  of Twilio Inc., 357 Beale Street, Suite 300, San Francisco, CA 94105 USA (hereinafter referred to as "Twilio") to transmit the codes.

Twilio may also process your personal information on servers in the United States. For this reason, in order to ensure an EU-compliant level of data protection, we have  entered into EU Standard Contractual Clauses (Art. 46 para. 2 c) GDPR), according to which Twilio is committed to complying with European data protection.

To support users in logging in via login link or login QR code, Equasio uses deep linking. To do this, we use Branch.io's technology.  To make this possible, information of a general nature is collected at the time of automatic login  (IP address, cookie, browser type).

Measures for data security and location of data processing

We protect your personal data according to the state of the art with appropriate technical and organizational measures. All employees and authorized professionals of Equasio AG who can access your data are bound by the GDPR, the FADP and the corresponding Swiss law and other legal regulations for the protection of your data.  We process your data carefully in order to ensure an appropriate level of protection of the security, in particular its integrity and confidentiality, and not to disclose it to third parties without authorization. The employees involved in processing operations are sensitized and trained with regard to the data protection requirements. Third parties will not be granted access to your personal data without your explicit consent.

Your data is stored in a data center in Switzerland . Backups are stored geographically separated in a data center in Germany. In addition, we require our external service provider to use your personal data exclusively in accordance with our specifications and in accordance with this data protection declaration and the legal requirements for order processing.

In order to protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g. SSL) via HTTPS. 

Disclosure due to legal obligation

We reserve the right to disclose your personal data if we are required to do so by law or if we are required to disclose it by public authorities or law enforcement agencies.
